Terms of Service.

These Terms of Service (“Terms”) form a binding agreement between you and H7 Pulse Enterprise Ltd. (“H7 Pulse”). By creating an account or using our website, portal, or services (the “Service”), you agree to these Terms and to our Privacy Policy. If you are using the Service for an organization, you confirm you have authority to bind that organization.

H7 Pulse provides the H7Pulse WA API Integration and related tooling — including messaging session provisioning, a REST API, usage dashboards, and a prepaid wallet. We may add, change, or remove features over time to improve the Service.

To use most features you must create an account. You agree to:

• Provide accurate, current information and keep it up to date.
• Keep your password and API keys confidential and secure.
• Enable available security measures, such as two-factor authentication, where appropriate.
• Be responsible for all activity that occurs under your account.

Notify us immediately at support@h7pulse.com if you suspect unauthorized access.

You agree not to use the Service to:

• Send spam, unsolicited messages, or any communication that violates the policies of H7Pulse WA, Meta, or other downstream providers.
• Break any law, infringe others' rights, or transmit malware or harmful content.
• Harass, defraud, or deceive recipients, or impersonate any person or entity.
• Probe, overload, or circumvent the Service's security, rate limits, or quotas.
• Resell or sublicense the Service except as expressly permitted in writing.

You are solely responsible for the content of the messages you send and for obtaining any consent required from your recipients.

The Service uses a prepaid wallet. You add credit by submitting a top-up request with proof of payment, which we review and approve. Usage — such as per-message charges at the published rates — is deducted from your balance.

• Charges already incurred and consumed balance are non-refundable except where required by law.
• Prices and rates may change; material changes will be communicated in advance.
• You are responsible for any taxes associated with your use of the Service.
• We may suspend service if your balance is insufficient to cover usage.

API keys are credentials that identify your account. Keep them secret and never embed them in public code or client-side apps. You are responsible for all activity authenticated with your keys. You can rotate or revoke keys at any time from your dashboard, and we recommend doing so immediately if a key is exposed.

The Service, including its software, design, and branding, is owned by H7 Pulse and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You retain ownership of your own data and content; you grant us only the limited rights needed to operate and provide the Service to you.

We work hard to keep the Service reliable, but it is provided on a best-effort basis and may occasionally be unavailable for maintenance, updates, or reasons beyond our control. We may modify or discontinue features, and will give reasonable notice of significant changes where practical.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that messages will always be delivered, as delivery depends on third-party networks.

To the maximum extent permitted by law, H7 Pulse will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three months before the event giving rise to the claim. Some jurisdictions do not allow these limits, so they may not fully apply to you.

You may stop using the Service and delete your account at any time; account deletion runs after a 14-day grace period. We may suspend or terminate access if you breach these Terms, create risk for the Service or other users, or as required by law — using reasonable notice where practical, or immediately for serious violations. On termination, your right to use the Service ends and any outstanding obligations remain due.

These Terms are governed by the laws applicable at H7 Pulse’s place of establishment, without regard to conflict-of-law rules. We’ll always try to resolve disputes with you directly first — please contact us before pursuing formal action.

We may update these Terms from time to time. When we make material changes, we’ll update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
